生成式人工智能影响下的科技期刊产业链权益问题解析

摘要:

【目的】

梳理科技期刊产业链的构成要素及权益关系,重点分析生成式人工智能(Generative Artificial Intelligence,GenAI)的影响,提出潜在权益问题及应对建议,以促进科技期刊产业可持续发展。

【方法】

采用次级资料分析法,以“科技期刊产业链构成—参与者权益关系—潜在权益问题的应对建议”为主线思路。

【结果】

当前科技期刊产业链主要由9个论文版本、3种发展形态构成,涉及作者、期刊编辑等多方参与者;数据版之后的发展形态受GenAI影响显著,因其不再直接介于读者、作者和期刊之间,而是围绕语料库与大语言模型的开发,权益关系更为复杂。

【结论】

GenAI影响下潜在权益问题的应对建议包括:在法律层面明确界定合理使用范围,在协议层面明确界定授权许可范围,在期刊层面树立产业链全局观念,力求为我国科技事业发展提供最大推力。

Abstract:

[Purposes]

This study aims to sort out the constituent elements and rights relationships of the scientific journals industry chain, identify potential rights issues, and propose corresponding countermeasures, with a focus on the impact of generative artificial intelligence (GenAI), to promote the sustainable development of the scientific journals industry.

[Methods]

Utilizing secondary data analysis, this study followed the main thread of "composition of the scientific journals industry chain—rights relationships of stakeholders—strategies for addressing potential rights issues". [Findings] The current scientific journals industry chain is primarily composed of nine paper versions and three developmental forms, involving multiple stakeholders such as authors and journal editors. The most significant impact of GenAI is observed on the developmental form subsequent to the data version, as it is no longer directly between readers, authors, and journals, but rather around the development of corpus and large language models, making the rights and interests more complex.

[Conclusions]

In response to the potential issues under the influence of GenAI, the proposed suggestions include: clearly defining the scope of fair use at the legal level, clearly delineating the scope of authorization and licensing at the contractual level, and establishing a holistic view of the industry chain at the journal level, strive to provide the maximum impetus for China's scientific endeavors.
