摘要:

【目的】 为了更好地保护作者和期刊出版单位的合法权益,需要对科技期刊著作权协议进行规制。【方法】 以《中文核心期刊要目总览(2020年版)》第四编自然科学中的综合性科学技术类共120种科技期刊的著作权协议为研究对象。采用实证研究的方法,从协议名称、转让或许可使用权利的种类、违约责任及争议处理、数字出版告知作者情况等方面对中国科技期刊著作权协议现状和存在的问题进行分析。【结果】 部分期刊出版单位对所签订的著作权协议性质的理解存在偏差,著作权协议存在所转让权利种类约定不明确、不能满足数字出版需求、没有明确违约责任及争议处理办法等问题。【结论】 期刊出版单位应制定科学合理的著作权转让或许可使用协议,加强对数字出版物版权的保护力度,明确重复转让或许可使用的权利归属,完善期刊著作权转让与专有许可登记制度,从而确保著作权协议的法律效力。

Abstract:

[Purposes] In order to better protect the legitimate rights and interests of authors and journal publishing units, regulation of copyright agreements for scientific journals should be implemented. [Methods] This paper took the copyright agreement of 120 comprehensive scientific journals in the fourth natural science category in Chinese Core Journal Catalogue (2020 Edition) as the research object. Using empirical research methods, this paper analyzed the current situation and problems of copyright agreements for Chinese scientific journals in terms of agreement names, types of transfer or exclusive license rights, resolution of liability for breach of contract and disputes, and digital publishing information for authors. [Findings] Research has shown that some journal publishing units have a deviation in their understanding of the nature of copyright agreements signed. Copyright agreements have issues such as unclear agreements on the types of rights transferred, inability to meet digital publishing needs, lack of clear liability for breach of contract, and lack of dispute resolution methods. [Conclusions] Journal publishing units should formulate scientific and reasonable copyright transfer or exclusive license agreements, strengthen the protection of digital publication copyright, clarify the ownership of rights for repeated transfers or exclusive licenses, improve the registration system for journal copyright transfer and exclusive licenses, and ensure the legal validity of copyright agreements.
