摘要:
目的 以生物医学OA期刊为例,分析其在与国际数据库合作过程中存在的法律问题并提出对策,为中国科技期刊的国际传播工作提供法律保障及参考。 方法 以被DOAJ、Scopus、PMC等国际数据库收录的上海市生物医学期刊为研究对象,分析上述期刊与国际数据库合作过程产生的相关法律问题,具体涉及信息网络传播权的转让、许可协议的命名及内容,期刊的商业模式,OA期刊采用CC协议的类型及注意事项,并提出解决策略。 结果 与数据库合作相关的法律问题包括著作权协议命名错误、信息网络传播权命名错误、许可的时间与空间不明确、期刊对于数据库的商业属性不加以区分;OA期刊对CC协议的认知不足、期刊误以为信息网络传播权只适用于全文而不适用于摘要等问题。此外,中文OA期刊存在CNKI优先发表的情形,与OA即时、免费的特征相冲突。除CC BY和CC BY-SA外,采用其他CC协议的OA期刊在与国际数据库合作时均需从作者一方获得信息网络传播权的转让或专有许可。 结论 建议科技期刊规范著作权协议及授权条款,明晰时空范围,正确命名和实践信息网络传播权,为期刊与国际数据库之间的合作提供坚实有力的法律保障及参考。

Abstract:
Purposes To analyze the legal issues in the cooperation process of biomedical OA journals with international databases and propose solutions, and to provide a reference for the international dissemination of STM journals. Methods This study took biomedical journals in Shanghai as an example, analyzed the transfer, licensing, and correct-naming of information network transmission rights, as well as Creative Commons (CC) licenses, among journals indexed by DOAJ, Scopus, PMC. Findings Legal issues related to collaboration of journals with databases include incorrect naming of copyright agreements and information network dissemination rights, ambiguities in the time and geographical scopes of licensing, and journals failing to distinguish the commercial features of databases. Additionally, there is insufficient awareness among OA journals regarding CC licenses, the misconception that information network dissemination rights apply only to full texts but not to abstracts, and issues such as CNKI priority publication in China’s OA journals. Except for CC BY and CC BY-SA, OA journals using other CC licenses must obtain the transfer or exclusive license of information network dissemination rights from authors when collaborating with international databases. Conclusions It is recommended that STM journals should standardize copyright agreements and licensing terms, clarify time and geographical scopes, correctly name and implement the information network dissemination rights, and provide solid and robust legal references for cooperation between journals and international databases.
