摘要：

【目的】 探究国际文本与数据挖掘(Text and Data Mining, TDM)版权新策对我国科技期刊的启示。【方法】 梳理TDM在国际立法界、司法界以及出版商界的发展动态,归纳国际TDM版权新策特征。【结果】 TDM符合鼓励创新的版权立法宗旨,在国际立法界、司法界以及出版界得到广泛梳理,并获得不同程度及不同方式的认可。【结论】 科技期刊界应当积极梳理TDM的国际发展动态,厘清其法理本质,夯实相关行业政策联盟,在国际合作谈判中主动嵌入相关合理使用许可谈判,并且考虑加强与技术产业界合作,联合建立国内科技期刊数字平台,为科研人员开展TDM合理使用提供坚实支撑。

Abstract:

[Purposes] This study aims to summarize the development of text and data mining (TDM) in international legislation, judicial practice and publishing industry, and to propose implications to Chinese scientific journals. [Methods] Based on the study of TDM in international legislation, judicial precedent and publishing industry, the features therein were identified. [Findings] TDM conforms to the legislative goal of encouraging innovation, which has been studied widely in international legislation, judicial precedent and publishing industry, and has been accepted with different degrees and methods. [Conclusions] scientific journals are highly suggested to identify the TDM legality, forge related policy alliance, involve proactively related discussion and clause in licensing negotiation, and consider setting up a specialized scientific online database with technology sectors to support fair use of TDM for researchers in China.
