预印本平台著作权政策内容的构建

摘要:

【目的】 应对预印本著作权政策机制不完善等挑战,促进这一全新学术交流机制的发展。【方法】 以著作权政策内容的构建作为突破点,剖析权利构成,厘清权利归属,精炼法律问题,借鉴国际知名预印本平台著作权政策并结合我国法律环境提出本土化解决方案。【结果】 制订内容完善的预印本平台著作权政策,可合理规避法律风险、消除各方顾虑,对促进预印本在我国的发展具有重要意义。【结论】 建议我国预印本平台在著作权政策中规定所接收稿件的范围和对稿件的初步审查事项,规定预印本论文著作权许可的一般规则和具体许可协议、条款,就翻译作品、文本与数据挖掘等特殊问题制定政策,完善投稿告知事项,建立预印本和最终出版版本的关联机制与沟通渠道,设立法律风险提示条款。

Abstract:

[Purposes] Preprint is a new academic communication mechanism. This paper aims to cope with the policy challenges of preprints, so as to promote the development of preprint in China. [Methods] This paper proposed the preprint copyright policy by analyzing the composition of rights, clarifying the ownership of rights, refining legal issues, transplanting the internationally renowned preprint platforms' copyright policy, and proposing a localized solution based on China's legal environment. [Findings] A comprehensive copyright policy for preprint platforms can avoid legal risks and promote the development of preprints in China. [Conclusions] It is suggested that China's preprint platforms include the following contents in its copyright policy: the scope of accepted manuscripts, preliminary review obligations, general rules for copyright licenses, the policy of translation works, the policy of texts and data mining, notification obligations for submissions, link mechanisms between preprints and their published versions, and disclaimer terms.
