Abstract:

[Purposes] Through the research on rights confirmation and countermeasures, it is expected to promote the efficient sharing and compliant utilization of paper-related data in China. [Methods] Via literature and network research, we sorted out the relevant copyright policies and guideline documents of scientific journals and data warehousing. In combination with the three rights separation theory in Twenty Measures on Data, we analyzed the corresponding rights and rights confirmation practices from the four stages of data collection, submission, management, and reuse. [Findings] In practice, there are problems such as the lack of laws related to data rights confirmation which restricts the relief paths, the incompleteness of relevant norms regarding data rights of scientific and technical journals that affects data sharing, the uneven distribution of data rights which harms the interests of some entities, and the conflict of data sharing agreements which blocks the sharing willingness of paper authors. [Conclusions] Countermeasures including popularizing and refining data rights registration criteria, formulating and improving relevant regulations of scientific and technical journals data rights, complying with the FAIR principle to regulate data property rights management, and improving the authorization selection rules of data sharing agreements are proposed. Maximizing the value of data requires the joint efforts of researchers, scientific and technical journals, data warehousing, and other multiple parties.

【目的】 通过确权问题和对策研究,推进我国论文关联数据的高效共享与合规利用。【方法】 通过文献及网络调研,梳理科技期刊和数据仓储相关的版权政策、指南文件,并结合《数据二十条》的三权分置理论,从数据采集、提交、管理、重用4个阶段分析相应权利和确权实践。【结果】 实践中存在数据确权相关法律欠缺导致救济路径受到制约、科技期刊数据权利相关规范不完备影响数据共享、数据权利分配不均导致部分主体利益受损、数据共享协议冲突导致论文作者共享意愿遇阻等问题。【结论】 提出普及并细化数据权利登记准则、制定并完善科技期刊数据权利相关规范、遵守FAIR原则以规范数据产权管理以及完善数据共享协议授权选择规则等对策。论文关联数据确权需要科研人员、科技期刊、数据仓储等多方主体通力合作,以最大限度实现数据价值。
