摘要：

目的 分析金色OA与钻石OA期刊著作权协议及许可中存在的问题并给出解决问题的对策，为我国科技期刊制定完善的著作权转让协议及许可协议提供参考。 方法 筛选上海市科技期刊学会生物医学期刊集群及Researching刊群—医学期刊集群中的金色OA和钻石OA期刊，并对期刊的语种、CC协议、出版商、APC、著作权协议等内容统计后进行可视化分析。整理并分析著作权转让协议及许可协议中存在的问题。 结果 本研究样本期刊的著作权协议存在诸多问题：如信息网络传播权命名错误、约定了出租权、滥用展览权等著作权的财产权约定不清晰、适用错误等情形；又如缺少支付对价、缺乏联机商业数据库收录相关的信息网络传播权的约定（采用CC BY的OA期刊除外）等协议条款；再如协议中缺少违约责任、争议解决的办法、著作权协议有关的时间与空间等约定条款。此外，期刊论文在CNKI优先发表（付费下载）的时间早于期刊官网（免费下载）与OA即时免费的特征相冲突。 结论 金色OA和钻石OA期刊的著作权协议应根据法律法规，结合期刊出版的实际情况进行合理约定，进而保护各方的合法权益。

Abstract:

Purposes To analyze the issues in the copyright agreements and licenses of gold OA and diamond OA journals， and bring forward the solutions to these journals， in order to provide reference for the development of comprehensive copyright transfer agreements and license for OA scientific， technical and medical （STM） journals in China. Methods We selected the gold OA and diamond OA journals from the member journals of Researching Journals’ Group and the Committee of Biomedical Periodicals Journals’ Group of Shanghai Society for Scientific and Technical Periodicals， and evaluate their language， CC license， publisher and APC. Then we visualized and analyzed the content of copyright agreements and licenses after statistical analysis. The issues in the copyright transfer agreement and license agreement were organized and analyzed. Findings There are many incorrect expressions or applications in the copyright agreements of the sample journals in this study， such as incorrect naming of the right of communication through information network， mistakenly applying the rental rights， exhibition rights abuse， and incorrect application， the missing of payment agreement and authorization on the right to disseminate information through online commercial databases （excluding CC BY journals） as well. Moreover， there was also a lack of provisions on liability for breach of contract and dispute-resolution methods， as well as an absence of clauses defining the temporal and territorial scope of the copyright. In addition， the priority of publishing on CNKI （paid download） earlier than on the journal’s website conflicts with the features of OA （instant and free）. Conclusions The copyright agreements of gold OA and diamond OA journals should be drafted in a manner consistent with the Copyright Law of the People’s Republic of China and the Regulations on the Protection of the Right of Communication through Information Network， taking into account the practical realities of journal publishing so as to safeguard the legitimate interests of all parties.
