摘要： 分析了在医学期刊作品中与著作权有关的不正当竞争行为，从内容和形式上论述《反不正当竞争法》对医学期刊作品著作权的维护和补充。通过运用利益衡量和道德标准来判断、揭示与著作权有关的不正当竞争行为，以限制、约束行为人的违法行为；期刊社（编辑部）以此为依据在编辑工作中起着第一道防线的防御作用。
